Marchman Act

The Marchman Act, Chapter 397 of the Florida Statutes, is designed to help individuals impaired by drugs or alcohol to overcome their substance abuse problems. It offers a stronger alternative to people checking themselves into rehab for a week and then checking themselves right back out. Under the Marchman Act, the authority of the Florida court keeps individuals in treatment.

The Marchman Act: Providing Help for Substance Abuse

Any family member or unrelated individuals with direct knowledge of the relevant facts can petition the court to become involved and order the allegedly impaired person into treatment. The first step is assessment: the court will determine whether or not the person is a danger to himself or herself or to others. The second step is treatment: the individual may be ordered to attend counseling sessions, enter an intensive inpatient residential treatment program or more.

Because this is a formal court procedure, all the rules of evidence are in play. In addition, the respondent will also have a court-appointed attorney fighting for him or her. That is why it is vital that you do not try to navigate this process on your own.
